A commercial burglary most commonly occurs when a person enters a commercial establishment with the intent to commit a felony (usually theft). A commercial burglary can be charged as either a misdemeanor or as a felony – the distinction depends on a person’s record and the value of property stolen or crime committed.

If charged as a felony a person can be sentenced up to three years in prison or even more if there are other enhancements involved. If charges as a misdemeanor a person can be sentenced up to one year in jail. These sentences are not usually handed out in these cases and a more typical sentence is a period of probation and perhaps a shorter county jail sanction.
