Marijuana possession occurs when a person knowingly possesses marijuana and knows that the substance is a controlled substance of some type.

There are a number of different ways to commit this crime which would then allow different charges to be filed ranging from an infraction to a felony. If you are in possession of concentrated cannabis then the case can be filed as a misdemeanor or as a felony. If you are in possession of more than 28.5 grams of marijuana then the case is a misdemeanor with a maximum sentence of six months in county jail and/or a $500 fine. If you are in possession of 28.5 grams or less of marijuana then the case is an infraction (like a regular traffic ticket) and the maximum sentence is a $100 fine.
